What's next
Once you receive your Power of Attorney, you need to take two steps more before it can be sent to your attorney in Spain. Your Power of Attorney needs to be notarised and legalised. 1. Notarisation When you receive your Power of Attorney from us, you need to print it off and take it with you to sign it before a Notary Public, who will attest your identity and signature. There are Notaries Public in most areas of the UK. You can find a local Notary Public by following this link to the Notaries Society, and using the service 'Find a Notary'. See the important note about notarisation in the left-hand side box below. 2. Legalisation Once your Power of Attorney has been notarised, it needs to be legalised by the Foreign & Commonwealth Office before it can be used in Spain. Your Notary might be able to arrange this for you. Otherwise, legalisation can be undertaken by post by sending your Power of Attorney to: The Legalisation Office You should include a self-addressed envelope for return and proof of online payment or a postal order or company cheque to pay their fee and postage. Visit the FCO's website for more details. Their fee is currently £30 per document, and the postage is £6. The FCO aims to process documents in 24 hours but legalisation may longer during busy periods or if there are postal strikes or other disruptions. Once you receive your Power of Attorney from the FCO, it will be ready to be used in Spain! |

1. Filling in the application form: The first step is to download our application form. You will have to fill in all your personal details and those of your attorney, so that we can include them in the relevant sections of your Power of Attorney. You may need to ask your attorney to give you his or her personal details so that you can enter them in the form. Note that you can appoint more than one attorney. The application form also includes a series of questions about the extent of the powers that you want to grant to your attorney. It is important that you clearly specify what you want and do not want your attorney to be able to do. Spanish Powers of Attorney are often drafted in a wide way, so that the attorneys do not encounter any problems when they need to perform an act which is subsidiary to the transaction in which they are representing you. However, you can perfectly narrow those power down if you are not happy giving too much powers of representation. We strongly advise you to discuss with your prospective attorneys the powers that they need to be given to be able to act for you in the transaction. You must also check our Terms and Conditions before submitting your application.
2. Send us the application form: For your convenience, the application form has been prepared in Word format, so that you can download it and easily edit and save it in your computer. Once you have filled it in with all the details, send it by e-mail to info@jpslegal.com We will confirm safe receipt of the application and will contact you should we need any clarifications on the information that you have provided.
3. Process the payment For your convenience, you can pay online by card using our secure payment site. You can pay directly with your credit or debit card, or you can even use a PayPal account if you have one. Payment by card is the fastest and safest method to make sure we receive the payment instantly and we can start processing your Power of Attorney. If you do not have a credit or debit card, please check our Payment section for more information. Please note that we cannot start processing a Power of Attorney until we have received the application form fully completed and the payment has been processed.
4. Receive your Power of Attorney! You will receive by e-mail a PDF version of your Power of Attorney in a maximum of 3 working days from the date when the completed application and the payment have been received. Together with the Power of Attorney you will receive detailed information on what to do next, but we recommend you to start familiarising yourself with the next steps by reading our 'What's next' section in the right-hand side column.

What is a Power of Attorney? A Power of Attorney is a document that authorises someone to act on your behalf in a legal or business matter. Why do I need a Power of Attorney? You may not want or be able to travel to Spain only for signing a document or may wish to leave a continuing matter in the hands of a lawyer, an agent, a relative or a friend. A Power of Attorney will allow them to sign any documents on your behalf within the limits that you set in the Power of Attorney, and this may save you time and travel expenses. You can specify whether you would like to give your attorney wide powers to manage all your property in Spain or whether you only authorise him or her for a particular act, like obtaining your NIE Number or signing the purchase deed of your new Spanish property.

IMPORTANT NOTE For some transactions in Spain, your attorney may require a notarised and legalised copy of your passport (e.g. for obtaining a NIE Number). To save time and money, check this with your attorney before visiting your Notary.
